Services Provided
Ecliptic Creations provides personalized IT assistance and custom technology solutions for individuals and small businesses, including device setup, software installation, data backup, technical support, custom software development, and IT infrastructure setup. We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.
Client Obligations
When using our services, you agree to:
- Provide accurate information: All information about your devices, systems, and technical requirements must be accurate to ensure proper service delivery.
- Timely communication: Respond to requests for information, approvals, or feedback in a timely manner as outlined in your service agreement.
- Payment: Pay all agreed-upon fees according to the payment schedule in your agreement.
- Access: Provide necessary access to systems, accounts, or devices as required for service delivery, when applicable.
Intellectual Property Rights
All custom solutions, configurations, code, and materials created by Ecliptic Creations remain our property until final payment is received. Upon payment completion:
- You receive rights to use the final deliverables as specified in your agreement
- Ecliptic Creations retains rights to the underlying methods, techniques, and non-client-specific elements for use in future projects
- Ecliptic Creations retains rights to display the work in our portfolio and for promotional purposes
- Any third-party software, services, or solutions implemented in your project are subject to their respective licenses and terms
Limitation of Liability
Ecliptic Creations provides services "as is" without warranty of any kind, either express or implied. We are not liable for:
- Third-party hardware, software, or services used in your technology ecosystem
- Data loss during service provision despite reasonable precautions
- System downtime or performance issues caused by third-party providers
- Indirect, consequential, or incidental damages arising from our services
- Issues resulting from failure to implement recommended security measures
Term and Termination
Either party may terminate services according to the terms in your service agreement. Termination may involve:
- Payment for all completed work and expenses incurred
- Return of any client materials or equipment
- Removal of access to systems or accounts provided for service delivery
- Cessation of use of any unpaid deliverables
Governing Law
These Terms are governed by the laws of British Columbia, Canada. Any disputes shall be resolved through negotiation, mediation, or if necessary, through the courts of British Columbia.
Changes to Terms
We reserve the right to update these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services constitutes acceptance of any changes.
